SHIFTYAUTOS CONSULTING SERVICES AGREEMENT, DISCLAIMER & REFUND POLICY
Please review these terms carefully before purchasing, scheduling, submitting payment, or engaging Shiftyautos for consulting, approval assistance, financing strategy, entrepreneur program guidance, vehicle sourcing assistance, trade-in consulting, or related services.
1. Nature of Services
Shiftyautos provides premium consulting services centered on automotive acquisition, strategic financing guidance, and business program mentorship. Our services are advisory in nature and do not constitute legal, tax, or financial brokerage.
2. No Guarantee of Results
While our strategies are designed for maximum efficacy, Shiftyautos does not guarantee approvals, specific interest rates, or vehicle availability. Final decisions are at the sole discretion of third-party lenders and dealerships.
3. Pre-Qualification Process
Clients must undergo a preliminary assessment. Submission of data to Shiftyautos constitutes a request for strategic review and does not initiate a formal loan application until directed to a specific financial institution.
4. Consulting Fees
All consulting fees are earned upon the provision of strategy, advice, or administrative assistance. Fees are separate from any deposits or down payments required by third-party automotive sellers or lenders.
5. No Refund Policy
Strict No Refund Policy: All sales are final. Since consulting involves the immediate transfer of proprietary knowledge and professional time, we do not offer refunds once services have been initiated or payment submitted.
6. Discretionary Refund Policy
In exceptional circumstances, Shiftyautos may offer a discretionary partial refund or credit toward future services. Any such gesture is made without prejudice and does not waive our strict No Refund Policy.
7. Client Responsibilities
Clients agree to provide accurate, truthful, and timely documentation. Failure to disclose relevant financial history or submitting fraudulent data will result in immediate termination of services without refund.
8. Chargeback and Payment Disputes
Initiating a chargeback is a breach of this agreement. Shiftyautos reserves the right to report fraudulent disputes to credit bureaus and collection agencies, and to seek recovery of fees plus administrative costs.
9. Limitation of Liability
Shiftyautos' liability for any claim arising from our services is limited strictly to the amount of the consulting fee paid. We are not liable for indirect, incidental, or consequential damages.
10. Arbitration Agreement
Any dispute related to these terms shall be resolved through binding individual arbitration. Clients waive their right to participate in class actions or jury trials regarding Shiftyautos services.
11. Governing Law
This agreement is governed by and construed in accordance with the laws of the jurisdiction in which Shiftyautos is registered, excluding its conflict of law principles.
12. Electronic Consent
By submitting payment or engaging our platform, you provide electronic consent to these terms. A digital signature or 'click-to-agree' is legally binding under the ESIGN Act.
13. Acknowledgement
I acknowledge that I have read and agree to all terms of this Consulting Services Agreement, Disclaimer & Refund Policy as expressed on this page.
Shiftyautos is not a lender and does not guarantee approvals, financing terms, rates, payments, vehicle availability, or any specific result. All financing is subject to third-party lender approval, credit profile, income verification, down payment, vehicle selected, taxes, fees, and final contract terms. No Refund Policy
All consulting fees paid to Shiftyautos are non-refundable. Once a payment is processed, the engagement of professional time, proprietary resources, and network access begins immediately. By submitting payment, the Client acknowledges and agrees that they are paying for expert consulting time and strategy, not a guaranteed financial or mechanical outcome.
Discretionary Refund Policy
While all fees are generally non-refundable, Shiftyautos reserves the sole and exclusive right to issue a partial or full refund under exceptional, documented circumstances, as determined by management. Any such refund is a gesture of goodwill and does not waive our standard 'No Refund' policy for future transactions.
Client Responsibilities
Effective consulting requires full transparency. The Client is responsible for providing accurate and timely information regarding their credit profile, income, debt obligations, and financial history. Shiftyautos is not liable for any failure to achieve results due to Client omissions, misrepresentations, or lack of cooperation during the consulting process.
Chargeback & Payment Disputes
The Client agrees to contact Shiftyautos directly to resolve any concerns before initiating a chargeback or dispute with their financial institution. Unauthorized chargebacks will be vigorously contested and may result in the immediate termination of services and legal action to recover the disputed funds plus administrative fees.
9. Limitation of Liability
To the maximum extent permitted by law, Shiftyautos and its consultants shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of our consulting services. Our total liability for any claim shall not exceed the amount paid for the specific service in question.
10. Arbitration Agreement
Any dispute or claim relating in any way to your use of Shiftyautos services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.
11. Governing Law
These terms and any consulting services agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Florida.
12. Electronic Consent
By submitting payment, scheduling a call, or engaging in communications with Shiftyautos, you provide your express electronic consent to be contacted via text message, email, or telephone call at the number or address provided, including for marketing purposes.
13. Acknowledgement
By proceeding with Shiftyautos, you acknowledge that you have read, understood, and agreed to be bound by the Refund & Dispute Policy, Limitation of Liability, Arbitration Agreement, and all other terms set forth in this Consultant Services Agreement.
